Specific terms and conditions relating only to the Zenkai® brand can be found in the second part of this document.
Important information : in the event of a possible discrepancy between the French version of the general conditions of sale and another linguistic version, the original French text prevails.
These general conditions of sale (the “CGV”) are applicable to orders for products made under the terms herein. By placing an order with Srndpdt and its websites such as Scrumptious.ch, 4478iconic.ch, Zenkai.ch (non-exhaustive list), the consumer (the “Customer”) accepts the application of these General Conditions and the specific General Conditions .
No general conditions contrary to or deviating from these General Conditions and specific General Conditions are applicable between Srndpdt and the Client.
The general conditions of sale also apply to all products delivered directly by our partners whose products we sell.
By placing an order with Srndpdt, the Customer declares to enjoy the exercise of civil rights. Minors or persons under curatorship/tutorship must, prior to any purchase, provide written authorization from their legal representative or curator/guardian before being able to place an order.
Orders can be placed on our website www.scrumptious.ch as well as on all sites belonging to the Srndpdt company; this is also valid during fairs/events, in its own physical store, affiliated corner, pop-up store, as well as through sales channels such as “marketplace” and “social networks”.
Purchases made from “reseller” partners are not taken into account in our T&Cs or other conditions published herein. The conditions of sale and general conditions of the “reseller” partners are then authentic.
3. Conclusion of the contract
All indications relating to goods and prices as part of the ordering process are without obligation and non-contractual.
Orders are binding on the Customer. Therefore, orders cannot be modified or canceled.
The Customer receives a non-binding order confirmation from the seller. Srndpdt may cancel its offer without notice before communication to the Customer of the shipment, by which the contract with the seller is concluded. By placing the order, the Customer confirms that they are clear about the scope and content of their order.
- Srndpdt is available for any prior clarifications.
- Srndpdt assumes no responsibility for the fact that ordered goods can no longer be delivered due to lack of available stocks, additional supplies or cessation of production.
- Srndpdt remains free to delete or modify the offer of the products offered at its sole discretion and at any time.
The Customer cannot under any circumstances modify or cancel a Contract with Srndpdt when he has ordered items which have been manufactured and/or personalized at his request or when the ordered items are already being delivered.
The sales prices of the products are indicated in Swiss Franc (CHF). They include VAT and any reductions applicable on the day of the order.
Sales prices do not include delivery costs. The amount of delivery costs is added to the sale price during checkout.
Once the order has been validated, the price cannot be modified.
Srndpdt is authorized to modify, at its sole discretion and at any time, the price of the goods offered.
5. Delivery costs
Shipping costs are free in Switzerland only.
For some countries, a lower cost package is requested. Sometimes delivery costs are also free.
In certain special cases, packaging and/or handling charges may be added.
6. Delivery time
Generally shipping is made within 24 hours.
Delivery times are subject to the delivery times of the Swiss Post depending on the shipping method chosen at checkout when purchasing via the internet or other digital and telephone methods.
The delivery times indicated in these General Conditions are given for information purposes only. This is in no way a commitment. The Customer is required to accept any delivery of products, even if the delivery is received after the indicated deadline.
Failure to meet a delivery deadline does not give the Customer any rights against Srndpdt.
Orders are processed and shipped according to the schedules of Swiss Post, freight forwarders or other shipping partners. Typically, packages are shipped within 24 hours.
Delivery times vary depending on the package chosen by the customer when checking out, as follows:
- SWITZERLAND - Free
- INTERNATIONAL - Package (sometimes free)
The areas and deadlines can be consulted in the “ Areas and delivery times ” section.
The delivery time will be displayed during checkout in the “Delivery” section before finalizing your order and depending on the country of destination.
The delivery times mentioned are for informational purposes only. Srndpdt declines all responsibility in the event of late delivery.
Any import taxes and local taxes are borne by the Customer. The latter must, in this respect, consult the laws in force in his country/region.

Deliveries are generally made by the Swiss Post, by the shipping service mandated by Srndpdt or by the delivery services of our partners.
Deliveries are made by standard Economy or Priority and/or Registered shipping, in Switzerland and Liechtenstein as well as in all countries served by La Poste. However, deliveries to certain countries may be voluntarily refused although they are listed on the website.
If the Customer does not take possession of the goods sent by post within 7 days, Srndpdt may automatically consider the order as canceled and recover the goods. If a sale price has been paid, this will be returned to the Customer after possible deduction of costs linked to the return of the goods and bank taxes. If no price has been paid, the Customer may be charged for the costs of returning the goods.
When the goods are delivered by our "reseller" partners, the latter's special delivery conditions may apply.
8. Transfer of risks
The transfer of risks, which includes the risk of loss as well as deterioration of the goods, passes to the Customer upon receipt of the goods.
If the Customer does not take possession of the goods, the transfer of risk passes to the Customer upon return of the goods to Srndpdt.
If the Customer returns goods to Srndpdt, the Customer bears the risks until receipt of the goods by Srndpdt.
9. Terms of return or exchange
Items can be returned up to 30 days following the date of purchase, with receipt.
To be eligible for a return, the item must be unused and in the original condition and packaging.
Several types of products cannot be returned. Perishable goods such as food, flowers or magazines cannot be returned.
Likewise, products for intimate or health use, dangerous products, flammable gases or liquids as well as gift cards, downloadable software and personal care products cannot be returned.
In certain cases, only a partial refund can be granted:
Books with obvious signs of use.
Any item that is not in its original condition, is damaged, or has missing parts for reasons not due to error on the part of Srndpdt.
Any item returned more than 30 days after delivery.
In the event that a refund is due, the Customer will generally be refunded via the payment method used. In the event that this means of payment is not applicable, the reimbursement is made by bank/postal transfer to the Customer's contact details.
When selling in physical locations, a cash refund can be made as long as the item was purchased in the same location.
Once Srndpdt receives and inspects the returned item, Srndpdt will send an email to confirm receipt. Srndpdt will transmit to the Client the decision regarding the approval or rejection of the reimbursement request.
If the request is approved, the refund will be processed and a credit will automatically be applied to the credit card or original method of payment, or via bank transfer, usually within 5-10 business days.
10.1 Late or Missing Reimbursements
If the Customer has not yet received the refund, he must consult his bank account again.
Next, the Customer contacts the entity issuing their credit card, as there may be a delay before the refund is officially posted.
Then, the Client contacts his bank. There is often a processing time before a refund is posted.
If after carrying out all these steps the Customer has still not received their refund, they must contact: email@example.com by mentioning their first and last name, as well as the order/invoice number.
10.2 Sale items
Only new items at regular price can be refunded.
Sale items are not refundable.
To return a product, the Customer must send it by La Poste in a registered/signed parcel to: SRNDPDT LLC – Scrumptious - Chemin des Pâquerettes 7, 1260 Nyon, Switzerland.
Except in DOA cases (defective upon receipt), return costs are the responsibility of the sender. It is his responsibility to ensure that the goods are packaged correctly and that they arrive safely.
Payment for the goods can be made on the basis of an invoice payable in advance, by credit card (Visa, Mastercard, American express, Apple pay), by Paypal payment or by the Klarna application (depending on availability in your region). The list is non-exhaustive and subject to change at any time.
Srndpdt is in no way responsible for charges related to a debit.
By placing an order with Srndpdt, the Customer expressly authorizes Srndpdt to check its solvency with third party organizations.
Srndpdt may, unilaterally and without notice, impose a payment method on the Client or refuse to conclude a Contract with him.
Regardless of the payment method used, the Customer understands and accepts that his payment may pass through a financial intermediary subject to legal obligations regarding money laundering.
In the event of a transfer by e-banking, the Customer must use the contact details mentioned on the invoice, indicating their customer number and the order number.
12. Reservation of title
Subject to contrary provisions provided for by applicable legislation, ownership of the products delivered will not pass to the Customer before full payment for the products.
13. Product verification
The Customer must inspect the products within two days of receipt and must immediately notify Srndpdt of any defect or damage caused to the products. In the absence of notice from the Customer within the aforementioned period, the products are deemed to have been received in good condition, without defects or damage and accepted as is, with the exception of non-apparent defects.
If a non-apparent defect is discovered, the Customer must immediately, upon discovery, notify Srndpdt. The Customer will forfeit his rights in the event of late notice.
The products are guaranteed for 2 years; the warranty takes effect from the date of purchase indicated on the receipt/invoice.
Batteries, accumulators and bulbs are excluded from the warranty, excluding DOA (Defective on receipt).
The warranty does not cover defects resulting from an accident, improper handling, improper use or unauthorized modification or repair as well as defects which are the consequence of normal wear and tear in the product time.
To claim a warranty, the Customer must return the defective item under warranty at their own expense.
If Srndpdt finds a warranty case, it may, at its sole discretion, replace the defective product and/or parts with another product deemed equivalent, respectively with spare parts or carry out a repair. If there is no equivalent product or spare parts or if it is not possible to repair the product, Srndpdt may, depending on its assessment of the extent of the defect noted, compensate the Customer for the loss in value. of the item caused by the defect or reimburse the purchase price in full.
Srndpdt cannot be held responsible under any circumstances, with regard to the Customer or third parties, for any damage, including indirect or consequential damage, including in particular the loss of loss of profit, economy, production, contract, goodwill or business opportunities arising from a product defect. As such, the Customer waives any claim for damages in connection with a defective product. The Customer's only claims against Srndpdt are those appearing in this article in connection with the contract as regulated by these general conditions and/or product sold.
15. Protection of personal data
16. Modification of the General Conditions
Srndpdt reserves the right to unilaterally modify its General Conditions at any time and without notice. However, the Contract will be governed by the General Conditions in force at the time of its conclusion.
17. Applicable law and competent courts
The Contract as regulated by these General Conditions, the Specific General Conditions, and all subsequent orders are governed by Swiss law.
Subject to other mandatory forums provided for for contracts concluded with consumers, all disputes, differences or claims arising from the Contract and these General Conditions or relating to them, will be settled by the competent courts in 1260 Nyon, Switzerland.
SPECIFIC GENERAL CONDITIONS OF SALE
Concerns: Sales of the Zenkai® brand
Generally the average delivery time is 5 to 10 days.
The shipping time depends on the Customer's place of residence, but it can be estimated as follows:
● Switzerland: 6 - 12 working days
● Europe: 6 - 8 business days
● United States: 3 - 4 business days
● Australia: 2 - 14 business days
● Japan: 4 - 8 business days
● International: 10 - 20 business days
2. Departure warehouse
Srndpdt/Zenkai works with an on-demand fulfillment company that has facilities around the world. The shipment will be made automatically from the warehouse best suited to the Customer's geographic location and product availability.
3. Customs Fees
Additional customs fees and taxes may be charged. These charges are not the responsibility of Srndpdt/Zenkai and are charged by the local customs office.
Customs policies vary greatly from country to country. The Customer checks directly with their local customs office.
4. Order not received
Before contacting Srndpdt, the Customer checks the following points:
● Receiving the shipping confirmation email to detect any errors in the shipping address.
● Check with the local post office to see if they have the package.
● Checking with neighbors in case the courier left the package/order with them.
If the shipping address is correct and the package has not been left at the post office or with the neighbors, the Customer contacts firstname.lastname@example.org indicating their order number and the subject of the request.
If the Customer has found an error in their delivery address, Srndpdt may send a replacement order at the Customer's expense.
5.1 Order tracking
The Customer receives a tracking link by email when the order is shipped. In case of questions regarding the tracking or shipping of the order, the Customer sends an e-mail to email@example.com
5.2 Wrong/damaged product
Srndpdt is very sorry if the product the Customer orders arrives damaged.
In order to help Srndpdt resolve the problem quickly, the Customer sends an email to firstname.lastname@example.org within 2 days of receipt of the package with photos of the damaged product, its order number and any other useful details concerning the order.
Srndpdt/Zenkai does not offer returns or exchanges, but if the order presents a problem, the Customer email@example.com .
Refunds are only offered to customers who receive incorrect or damaged items. If this is the case, the Customer contacts firstname.lastname@example.org sending photos of the damaged items; Srndpdt will do what is necessary to reimburse you.
8. Exchanging an item for a different size/color
Currently, Srndpdt does not offer exchanges. If the Customer is not sure which size is best suited, size guides are available for each item listed on the store, in the “product description” section.
Although rare, it is possible that an ordered item may be mislabeled. If this is the case, the Customer sends an e-mail to email@example.com within 2 days of receipt of the order, indicating the order number and photos of the incorrectly labeled item; Srdndpdt will send a new item in exchange or refund it.
Competitions organized by the brands /Scrumptious, 44/78 Iconic, Zenkaï among others) of SRNDPDT LLC are subject to cancellation at any time and without notice, without any form of compensation being offered. By taking part in a competition, you consent to the final decisions taken by the organizers, and no possibility of appeal will be possible.
During draws, a single draw is made, bringing together entries from various platforms, emails or postal mailings.
The winners are personally informed of their victory.
Without specifications, the competitions are free and open to all.
